Personal Photos Taken During Tours

Participants are welcome to take personal photos and videos during the tour. However, the use of these images for commercial purposes without permission from Sun Select Bahamas Ltd is prohibited.

By participating in our boat charter tours, you acknowledge that photos and videos may be taken by our staff for promotional and marketing purposes.

These images may be used on our website, social media, and other promotional materials.

If you prefer not to have your photo taken or used, please inform our staff before the tour begins or contact us at contact@sunselectbahamas.com

Participation

1. Assumption of Risks

1.1 By participating in a day tour boat charter provided by the Company, SUN SELECT BAHAMAS Ltd., you acknowledge and understand that there are inherent risks associated with boating activities, which may include, but are not limited to accidents, injuries, animal behaviors’, loss or damage to personal property, and other potential dangers. You voluntarily accept and assume all such risks.

1.2 You agree that your participation in the Charter is entirely at your own risk and discretion, and you are responsible for your personal safety, well-being, and that of any minors or dependents under your care.

2. Safety Precautions

2.1 You are expected to follow all safety instructions provided by the crew and adhere to any safety guidelines and rules set forth by the Company during the Charter. Failure to do so may result in your removal from the Charter.

3. Health and Medical Conditions

3.1 It is your responsibility to inform the Company, in advance, of any health or medical conditions that may affect the ability to participate safely in the Charter. Participants with limited mobility, bones injuries, pregnancies, heart conditions or any other conditions that may be affected by the ride might be denied boarding.

4. Alcohol and Substance Use

4.1 The irresponsible consumption of alcohol or the use of illegal substances during the Charter are prohibited. The Company reserves the right to refuse service or disembark any individuals who may disturb the tranquility or safety of others.

5. Booking, Cancellation and Refund Policy

5.1 Booking:

– Deposit: A 20% deposit is required to secure your booking. Full payment is due THREE DAYS prior to your scheduled trip. Failure to pay in full by this time will result in automatic cancellation.

5.2 Cancellation and refund policy:

– Full refund: If the company cancels the trip due to weather conditions or other unforeseen circumstances, a full refund will be issued at any time.

– Deposit refund: If you cancel more than THREE DAYS before your scheduled trip, the deposit will be refunded. If canceled within this period or failure to pay in full by this time, the deposit will be forfeited.

– 50% refund: If you cancel within THREE DAYS of your scheduled trip, 50% of the full payment will be refunded.

– No refund (0%): No refund will be issued for cancellations on the day of the trip or for no-shows, including cancellations due to personal concerns about weather conditions.

6. Changes to Charter

6.1 The Company reserves the right to make changes to the Charter, including but not limited to, the schedule, itinerary, vessel, and crew, as deemed necessary for safety, weather conditions, or other unforeseen circumstances.

7. Liability Release

7.1 To the fullest extent permitted by law, you release and discharge the Company, its owners, employees, contractors, and agents from any liability for personal injury, property damage, or wrongful death that may occur during or as a result of your participation in the Charter.

8. Indemnification

8.1 You agree to indemnify and hold the Company harmless from any claims, costs, and expenses, including legal fees, arising out of your actions or any claims made against the Company as a result of your participation in the Charter.

9. Agreement and Acknowledgment

9.1 By participating in the Charter, you acknowledge that you have read and understand this disclaimer, and you agree to be bound by its terms and conditions.

10. Governing Law

10.1 This disclaimer shall be governed by and construed in accordance with the laws of The Commonwealth of The Bahamas.
